Spying at Work

Supervision or harassment?

It is important not to confuse the employer’s right to manage an employee’s work or attendance, with spying on or watching the employee in an abusive way, which would constitute harassment.

A situation involving the exercise of the right of management

This is supervision:

The employer evaluates the employee’s performance and oversees their work.

The employer verifies an employee’s reasons for being absent.

This can become harassment:

If the employer is abusive, unreasonable and/or discriminatory in exercising their management right.

The employer installs a camera and aims it directly at one employee’s work station, and continuously records them, without any serious grounds to justify this behaviour.

The employer constantly calls an employee on their personal cell phone or follows them around during their work duties, without any serious grounds to justify this behaviour.
