Penalties

A company or its directors accused of criminal negligence are liable to a sentence of imprisonment or to a fine, the amount of which is unlimited for organizations, according Section 735 of the Criminal Code.

An individual accused of criminal negligence causing death is liable to a sentence of life imprisonment (Section 220 of the Criminal Code).

The maximum penalty for criminal negligence causing bodily harm is 10 years of imprisonment (Section 221 of the Criminal Code).

A company’s directors and officers can be prosecuted if they committed the criminal negligence offence directly or if they were party to the crime by being complicit in it (Sections 22(1)b), 21(1)c) or 21(2) of the Criminal Code).
